What Texas lets a home baker sell
Baking at home for money is legal in Texas under the cottage food law, and the rules
changed recently: Senate Bill 541 took effect on 1 September 2025 and rewrote how it
works. It used to be a list of twenty permitted items. Now it is the opposite, everything
is allowed except six categories: meat and poultry, seafood, ice and ice cream, low acid
canned goods, anything containing CBD or THC, and raw milk. Refrigerated baking is in for
the first time, so a cream pie or a cheesecake is now legal, and an operation selling one
has to register with the state, keep it cold in storage and in transit, and label it with
the date it was made.
Two things follow that are worth knowing before you order.
The label has to tell you it was not inspected. The wording is set by the statute,
and this is it:
This product was produced in a private residence that is not subject to
governmental licensing or inspection.
That sentence is not a warning about the baker. It is the deal: no permit, no inspection,
no commercial kitchen rent, and in exchange a cap on how much can be sold, currently
$150,000 a year in gross sales and now index linked. The operator has to hold a food
handler certificate, and since September 2025 they can register with the state and print a
registration number instead of putting their home address on your box.
They cannot post it to you. A Texas cottage food operation may sell online only if
the operator, an employee, or someone in their household hands the food to you in person.
SB 541 struck mail order out of the law entirely, and the permission it grants is for sales
inside Texas. So expect to collect, or to be met somewhere. Anyone offering to ship you a
cake from a home kitchen in Texas is either not a cottage operation or is not following
this rule.
